Terms & Conditions

A Legal Disclaimer

These Terms & Conditions ("Terms") govern the services provided by Cream&Butter, hereinafter referred to as "we", "us", or "our", to the client ("you" or "client"). By commissioning any project or service from us, you agree to these Terms.

1. Scope of Work

All services — including but not limited to branding, website design, marketing campaigns, and visual content creation — will be defined in a written proposal or agreement. Each project’s scope, timeline, and deliverables will be tailored and confirmed in writing prior to commencement.

2. Pricing and Payment Terms

  • Prices are quoted in CHF and are exclusive of VAT unless otherwise stated.

  • A 30–50% deposit is required to begin work unless otherwise agreed.

  • The balance is due upon delivery or as outlined in the payment schedule.

  • Invoices are payable within 10 days of issue unless otherwise specified.

  • Late payments may incur interest charges of 5% per month.

 

3. Project Reviews and Revisions

  • Projects include a defined number of review rounds, typically 2 unless specified otherwise.

  • Additional revisions beyond the agreed scope will be billed at our standard hourly rate.

  • Major scope changes may require a new quote or separate agreement.

 

4. Deadlines and Client Responsibilities

  • We agree to meet project timelines as specified, provided that all required materials and approvals are supplied on time by the client.

  • Delays caused by client inaction or late feedback may extend delivery deadlines and may incur additional charges.

  • We are not responsible for delays caused by third-party providers (e.g., web hosting, printers).

 

5. Intellectual Property

  • Upon full payment, you are granted rights to the final approved deliverables for the agreed usage (e.g., marketing, online, print).

  • We retain the right to showcase the work in our portfolio and promotional materials unless confidentiality is requested in writing.

  • Working files (e.g., PSD, AI, raw footage) remain our property unless otherwise agreed.

 

6. Cancellations and Refunds

  • If you cancel a project after work has begun, the initial deposit is non-refundable.

  • If substantial work has been completed, a fair portion of the total project fee will be invoiced based on time and resources invested.

 

7. Confidentiality

We treat all client data, documents, and communications as confidential and will not disclose any information to third parties without your written consent, unless required by law.

 

8. Dispute Resolution

Any disputes arising out of these Terms shall be governed by Swiss law. Both parties agree to attempt resolution through negotiation before pursuing legal action.

 

9. Changes to Terms

We reserve the right to modify these Terms at any time. The most current version will always be available on our website.
